Terms of Service

1. Acceptance of Terms

By accessing or using SimplAds.ai(the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Launchedads Limited Liability Company, doing business as SimplAds.ai("we", "us"), 4601 E. Douglas St., STE 150, Wichita, KS 67218, United States.

2. The Service

SimplAds.ailets you connect your own advertising accounts on Meta, Google Ads and TikTok, view and manage supported campaigns from one dashboard, generate advertising creative with AI, and review normalized performance reporting. The Service supports a documented subset of each platform's campaign types and fields; it is not a replacement for the platforms' native tools and does not guarantee that any campaign or ad will be approved or perform.

3. Accounts and Workspaces

You must provide accurate information and keep your credentials secure. You are responsible for all activity in your workspace, including by members you invite. You must be at least 18 and authorized to act for the business whose ad accounts you connect.

4. Subscription, Credits and Billing

Access to publishing campaigns and generating AI creative requires an active subscription or approved beta access. AI generation is metered in credits; the credit cost of each generation type is shown before you start a job. Credits are deducted only when a generation completes successfully; failed generations are not charged. Credits have no cash value and are non-transferable. Subscription fees are billed in advance and are non-refundable except where required by law. We may change prices with at least 30 days' notice.

5. Ad Platform Compliance and Your Responsibility

The Service connects to Meta, Google and TikTok through their official APIs, and your use of those platforms through the Service is subject to their terms and advertising policies. You are solely responsible for the content, targeting, legality and compliance of your ads and landing pages, for the ad spend you authorize, and for maintaining the platform accounts you connect. We are not liable for platform review decisions, account restrictions, policy enforcement or ad spend outcomes.

6. Acceptable Use

You agree not to:

• Connect ad accounts you are not authorized to manage
• Use the Service to violate any law, platform policy or third-party right
• Generate creative that is unlawful, deceptive, infringing or hateful
• Probe, scrape, reverse-engineer or interfere with the Service
• Resell or sublicense access without our written permission

We may suspend or terminate accounts that violate these rules.

7. Data and Privacy

We process data as described in our Privacy Policy. By connecting an ad account you authorize us to access and act on it through the platform's API on your behalf, within the permissions you grant. You can revoke that access at any time. You retain ownership of your data and creative; you grant us a license to host and process it solely to provide the Service. AI-generated assets are provided to you subject to the applicable provider's terms.

8. Availability and Third Parties

The Service depends on third-party platforms and AI providers we do not control. We do not warrant uninterrupted operation of those services and will show you the status and freshness of synced data. We may modify or discontinue features with reasonable notice.

9. Termination

You may cancel at any time; access continues until the end of the paid period. We may suspend or terminate your account for breach of these Terms or non-payment. On termination you may request export or deletion of your data as described in the Privacy Policy.

10. Disclaimer and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUNCHEDADS LIMITED LIABILITY COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, AD SPEND OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict-of-law rules.

12. Changes

We may update these Terms; the effective date above shows the current version. Continued use after changes means you accept them.
